Terms of Service

Last updated: [INSERT DATE] · Effective from: [INSERT DATE]

What this document is

These Terms of Service govern your use of the Trailivo marketing website (the public site you are reading) and the demo tenant at demo.trailivo.com. They are not the contract that governs a paid customer relationship.

If you become a customer, your use of the platform is governed by a separate Master Services Agreement (MSA) that we sign together. The MSA includes a Data Processing Agreement, license terms, support SLA, and tier-specific schedule. The terms below cover only the public website and the open demo.

1. Who we are

PIXELO MOBILE LTD, a private limited company incorporated in England and Wales (Company No. 10585806), with registered office at 565 Green Lanes, Haringey, London, N8 0RL, United Kingdom. References to "we," "us," "our," or "Trailivo" mean PIXELO MOBILE LTD. References to "you" mean the person or organization accessing the website or demo.

2. Acceptable use of the website and demo

You may use the marketing website and the demo tenant freely for the purpose of evaluating whether Trailivo is right for you. You agree not to:

3. The demo tenant

The demo at demo.trailivo.com is provided as-is, with no uptime guarantee. Its data is reset periodically (currently nightly). Anything you put into the demo may be visible to other prospects and will be deleted on reset. Do not enter real personal data, secrets, or anything you would not be comfortable seeing publicly.

If the demo is unavailable, please email [email protected] and we will let you know when it returns.

4. Intellectual property

All content on this website — including text, graphics, logos, and the structure and styling of the site itself — is the property of Trailivo or its licensors. You may not copy, reproduce, or republish substantial portions without written permission.

Trail names referenced in the case studies (Lycian Way, Via Francigena) and trail-organization names referenced elsewhere are used either with permission or as descriptive references; their underlying trademarks remain the property of their respective owners.

The platform source code is licensed separately to paying customers under the Trailivo Master Services Agreement. Use of the demo or website does not grant any license to that code.

5. No warranty (for the website and demo)

The website and demo are provided "as is" and "as available". We do not warrant that they will be uninterrupted, error-free, or fit for any particular purpose. We do not warrant that any information on the website is accurate at the moment you read it; we update it but it can drift.

This disclaimer applies only to the public website and demo. Customer warranties for the actual platform are spelled out in the MSA.

6. Limitation of liability

To the fullest extent permitted by applicable law, PIXELO MOBILE LTD's total liability arising from your use of the website or demo is limited to £100 GBP (one hundred pounds sterling). We are not liable for indirect, incidental, consequential, or special damages of any kind, including but not limited to lost profits, lost data, or business interruption.

This cap does not limit liability for fraud, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot be limited by English law.

7. Privacy

How we handle data is described in our Privacy Policy. By using the website or demo, you confirm you have read and understood it.

8. Third-party services and links

This website links to third-party sites (Calendly, the case study sites, App Store / Google Play). We are not responsible for the content or privacy practices of those sites; their own terms apply when you visit them.

9. Changes to these terms

We may update these terms from time to time. The latest version is always at the URL of this page. If a change is material — for example, changing the liability cap or acceptable-use scope — we will surface it on the website itself for at least 14 days before it takes effect.

10. Termination

We may suspend or terminate your access to the demo or website at any time if we reasonably believe you are in breach of these terms. Reasonable belief includes, but is not limited to, evidence of scraping, abuse of the demo, or attempts to gain unauthorized access.

11. Governing law and disputes

These terms are governed by the laws of England and Wales, without regard to conflict-of-laws principles. Any dispute arising from these terms or your use of the website will be subject to the exclusive jurisdiction of the courts of England, except that we may seek injunctive relief in any court with appropriate jurisdiction.

If you are a consumer in the European Union or the United Kingdom, this governing-law clause does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence.

12. General provisions

13. Contact

Questions about these terms: [email protected]. General inquiries: [email protected].

Implementation note (remove before publishing): only the two [INSERT DATE] fields at the top need filling. Entity (PIXELO MOBILE LTD), governing law (England and Wales), and jurisdiction (courts of England) are now resolved. A UK-qualified solicitor should still review sections 4 (IP), 6 (liability cap — £100 is conservative for a marketing site but appropriate), and 11 (governing law) before this goes live. These terms cover the website and demo only — your customer MSA is a separate document, also governed by English law, and should be drafted by counsel before signing your first paying customer.
